The U.S. District Courts preside over cases tried under most Federal laws.  Litigation in these courts can be between private parties or against the U.S. government.  The United States Attorney’s office utilizes the District Court to prosecute individuals for alleged crimes under Federal law.  District courts are also popular with civil litigants because they allow for jury trials.  The U.S. District Court for the State of Massachusetts covers the entire state.

In cases involving Federal tax controversies, a taxpayer cannot simply walk into U.S. District Court and file a complaint against the Government.  He or she must first pay the Internal Revenue Service (“IRS”) any amount in dispute, and then exhaust all avenues of administrative relief available to seek a refund of that amount from the IRS.  Only after these attempts to resolve the matter administratively have failed may the taxpayer then proceed in District Court.

Office of the U.S. Attorney – District of Massachusetts

The Office of the United States Attorney represents the Government in cases where it is a party to the dispute.  The U.S. Attorney maintains offices in Boston, Worcester and Springfield.  The U.S. Attorney’s office “prosecutes all criminal and civil cases brought by the Federal government and defends the United States when it is a party in a civil case.”  Its enforcement authority includes:

  • Prosecution of criminal cases brought by the Federal government;
  • Litigation and defense of civil cases in which the United States is a party; and
  • Recovery of debts owed the Government deemed to be administratively uncollectible.
